Key information for all Activities

– It’s important to wear suitable clothing when going to sea. This includes warm layers, suitable footwear (non-slip, able to get wet, not open-toed) and a hat. We will be happy to provide a spray jacket to you if you require one (provided your group numbers permit). We will always provide lifejackets to guests and indicate when they should be worn. 

– Always arrive at your boat for any charter trip at least 15 minutes before the departure time.

– Please listen carefully to the safety brief our team will give you prior to departure. 

– Whenever the boat/RIB is under way, please ensure that you keep one hand for the boat (ie hold on!) at all times! Boats/RIBs move dynamically and sometimes unexpectedly, and so it’s very important that guests hold on at all times with at least one hand to prevent falls/impact with the boat. 

– If you’re in any doubt, please check with us where your boat is departing from and at what time. 

– Please obey the safety instructions given by our staff at all times. 

– Please note that there are no toilet facilities at Les Ecrehous or Les Minquiers. 

– Please ensure you bring adequate drinks with you on RIB charters- these are open boats and it can be thirsty in the sun! 

– If you’re travelling to France with us, please remember your passport! It must be valid and in date. 

Any credit issued for postponed/delayed charters must be used within 12 months from the date credit was issued/a trip or service was postponed. 

– Any invoice/booking must be paid by the date indicated. A booking is not confirmed until payment has been made in full. Invoices that aren’t paid by the date indicated may attract late charges as detailed below. 

TERMS AND CONDITIONS FOR CHARTERS, BOAT TRIPS AND COURSES.

Any booking, payment of a deposit or settlement of any invoice (either in full or part payment of any course, charter, activity or trip) constitutes full agreement and acceptance on the part of the client to these terms and conditions. Please ensure you have read them fully and understand them before paying for any activity. We’ll be happy to clarify any parts of these terms and conditions before you book. 

Where an invoice has been issued, please note that it should be settled no later than the due date indicated, unless another arrangement has been agreed with Le Mourier management. For every week (or part thereof) payment is late, 10% of the additional invoice will be charged as a late penalty. 

Where an organiser is booking on behalf of a company, group or party, the organiser assumes responsibility for ensuring each member of their party has been made aware of and accepts these terms and conditions in full. Completing the booking process and/or settling any invoice in relation to that booking constitutes the organiser’s full agreement to these terms and conditions on behalf of each member of their party and acceptance of responsibility for the rules outlined in these terms and conditions.

Any client with any health condition likely to be impacted, exacerbated or influenced by engaging in the activity for which they’re joining (including but not limited to asthma, heart conditions, back pain or conditions and/or mobility problems, pregnancy, epilepsy, severe allergies etc) must notify Le Mourier Swim School Ltd. of this in advance of the course.

If a single organiser is booking for more than just themselves, they must notify us any of the above conditions for any members of their party so affected. Any activity can be forfeit at any time if our staff makes a decision that a client’s health does not permit their safe inclusion in the activity.

Changes to dates and times: sometimes a course or charter will need to be moved due to weather conditions or similar unforeseen circumstances. Le Mourier Swim School Ltd reserves the right to change course times and dates as necessary for safety reasons at any point, up to and including the date of the activity, or during the activity itself. Clients will be offered a replacement date/s in lieu of the postponed activity. Please note that postponements due to weather will not be grounds for a refund. Please see below for refund policy. 

Cancellations of courses due to participant numbers: Le Mourier Swim School Ltd. reserves the right to cancel a course if the numbers are below the minimum required by us to proceed with that course.

Payment:  Payment for all courses is to be made in advance and by the due date indicated. No guarantee can be given that spaces or times will still be available if a late payment is made. Payments may be made by telephone, cheque, debit and credit card (not American Express) and either paid at the office or by post with the relevant paperwork.

Refunds for COURSES: Should you wish to cancel your course, in some circumstances a discretionary refund (less a 15% cancellation fee) will apply provided that notice is given in writing up to 28 days before the course. All refunds are solely at the discretion of Le Mourier Swim School Ltd. management, without exception.

Eligibility: If you have any doubts about the suitability of a course for you, please speak to us before booking. We’ll be very happy to talk through you current ability and experience and help you select the most suitable course for you based on that. Some courses require a student to have a substantial level of experience/ability/pre-requisites; please do not book on without speaking to us first if you’re in any doubt as we may not be able to cancel/refund your attendance.

Tuition on your own vessel: Tuition can take place on a client’s own boat (assuming the boat itself is suitable for the course required). All such tuition will take place under the client’s own insurance and the liability throughout the training is theirs solely. Before the course starts, it is necessary for the client to check with their insurer to confirm that their insurance covers them receiving tuition on the boat (which is very standard and has never been a problem for any client before).

Courses/private sessions are non-refundable if the cancellation is within 14 days of the date of the activity.

Private tuition should be booked in and taken within 12 months from the date of booking.

Photography: It is possible that Le Mourier staff may film or take photos during activities. By booking you give your consent to this. Consent is also given by booking that these images can be kept on our secure database to be held solely for Le Mourier Swim School and which will not be given to any third party. Images may be used on our social media channels or in marketing materials. Please let us know if you wish to withdraw this consent.

Any change, amendment or deviation from the above will solely be at the discretion of the managing director of Le Mourier Swim School Ltd.

It is the responsibility of each participant on any boat trip/tour/charter to notify Le Mourier Swim School Ltd before booking of any health conditions which may be affected/ exacerbated or otherwise negatively impacted by boat travel. This includes back problems or pain, pregnancy, heart conditions, asthma and any and all conditions requiring urgent/regular medication or special care or treatment which would be difficult/not be available at sea.

Where there is a single organiser of a charter on behalf of a group or party, it is the organiser who must check with each individual member or their party regarding the above health considerations before booking. By completing the booking, the organiser is confirming that they have checked with every individual member of their party and received confirmation that each attendee has no such conditions needing to be brought to Le Mourier Swim School Ltd.’s attention.

Changes to dates and times: Sometimes a charter will need to be moved due to the forecast weather conditions (or similar circumstances). Le Mourier Swim School Ltd reserves the right to change charter/trip times and dates as necessary for safety reasons. When a charter is postponed, clients will be offered a replacement date in lieu within the same calendar year as the postponed trip. Any refunds due to a weather cancellation (whereby the an alternative date isn’t accepted) will attract a 15% cancellation fee. If you can only take a trip/charter on a single date, please notify us of this before booking.

Payment:  Payment for all charters is to be made in full and by the due date indicated. No guarantee can be given that spaces or times will still be available if a late payment is made. Refunds for CHARTERS/BOAT TRIPS: Should you wish to cancel your charter, in some circumstances a discretionary refund (less a 15% cancellation fee) will apply provided that notice is given in writing at least 14 days before the charter. All refunds are solely at the discretion of Le Mourier Swim School Ltd. management, without exception. If credit is issued, it must be used within 12 months of the date of issue or agreement sought in writing to extend it. In the unlikely event Le Mourier Swim School Ltd. needs to cancel your charter due to technical reasons, a full refund will be given. If  your charter needs to be postponed due to unsuitable weather conditions on the date chosen, credit will be issued in full and the trip will be postponed- this is not grounds for a full refund. Any refunds due to a weather cancellation (whereby the an alternative date isn’t accepted) will attract a 15% cancellation fee. 

Damage:  Any damage to any vessel or equipment belonging to Le Mourier caused by a client during a charter will be billed to the client or to the organiser or company responsible for the charter’s original booking. By completing the booking process and accepting these terms and conditions clients and attendees of any trip or charter accept liability for any damage to Le Mourier Swim School Ltd. property, negligent inflation of lifejackets, damage caused by drink or food spillage, any other form of fouling such that may require cleaning to restore the vessel to a serviceable condition, and blocking or damage to WC facilities.

Lifejackets will be provided to each guest, and should be worn whenever indicated by our staff. If a guest inflates a jacket negligently without being directed to/for reasons of safety while in the water, a charge of £75 will apply per inflated lifejacket to cover the costs of the third party company servicing and certification required to return the inflated lifejacket to service.

Minimum numbers will apply to some charters and a full refund will be offered if a trip can’t run due to a shortfall in numbers.

if you have particular requirements as to vessel or any special conditions needing to be met, please speak to us before booking so that we may do our best to facilitate.

Luxury cruiser charters have a standard 5 hour duration. This assumes a maximum of 2 hours ‘engine time’. Charters can be extended upon request at an additional cost.

Charters Aboard “Amour Toujours” – It may be possible to arrange a BBQ during charters aboard our Luxury Cruiser “Amour Toujours”. Please enquire about this possibility at the time of booking.

 

Vessel Deliveries

When engaged to collect, transport or deliver a vessel, it is the client’s responsibility to ensure in advance of the date of delivery that the vessel will be seaworthy and safe to be transported. Full specifics of the vessel must be provided to us, and she must be in a serviceable and seaworthy state upon our arrival ready to turn key and leave.

Should we fail to receive complete information regarding the boat or its whereabouts, or we find it in a condition unsuitable to undertake the passage required to deliver it, we reserve the right to leave the vessel in situ if we feel that would be the safer option. This may incur costs up to the full charge made for the delivery so it is imperative clients fully prepare, survey and ensure that a vessel to be delivered or transported is fully ready and they have all information in their possession which enables the delivery to proceed.

If we are contracted to deliver a vessel on a particular date we will reserve a delivery ‘chase boat’ and book our staff accordingly. If a vessel is not ready on that date, a minimum 20% cancellation fee will apply. We therefore strongly advise clients to make certain the boat to be delivered is ready to go and payment is cleared before booking us.

We will endeavour to choose the best weather window for each and every delivery we undertake based on the up to date forecasts. In some instances the weather/sea state will be worse than was forecast, and we may need to cancel or pause a delivery. If we have made a fair and reasonable effort but have been unable to complete, the delivery fee will stand even if the vessel did not reach its ultimate destination following this attempt. 

 

Changes to dates and times

Deposits (ordinarily 25% paid up front or as part of a total payment) are not refundable.

Sometimes a trip will need to be re-scheduled due to weather conditions or similar unforeseen/unavoidable circumstances other than detailed in these terms and conditions. Le Mourier Swim School Ltd reserves the right to change times and dates as necessary for safety reasons based on conditions, weather or for any reason relevant to the safety of those onboard- our assessment of the weather for any charter is final and our decision as to whether the charter can proceed is the deciding factor. Clients will be offered a replacement date in lieu of the postponed activity and which will ordinarily take place within 12 months of the date of the original charter. In certain circumstances, where we were unable to offer a re-scheduled date/s for the cancelled charter, a refund of the charter cost may be offered to which a 25% cancellation fee will apply.

If a client wishes to move their date we must receive that request in writing a minimum of 14 days before the date of their charter.

If a client wishes to cancel their charter, a 25% cancellation fee will apply up to 14 days before, after which the charter is non-refundable.

Please ensure that you have confirmed your departure point/trip times/boat at time of booking to be certain where your trip starts and finishes- confirmation will always be given on an invoice or our booking system and there are a range of different departure points used so it’s important to be certain. We’ll be delighted to confirm your trip details to you at any time leading up to the trip. 

Damage

Any damage to any vessel or equipment belonging to Le Mourier caused by a client during a charter will be billed to the client or to the organiser or company responsible for the charter’s original booking. By completing the booking process and accepting these terms and conditions clients and attendees of any trip or charter accept liability for any damage to Le Mourier Swim School Ltd. property, negligent inflation of lifejackets, damage caused by drink or food spillage, any other form of fouling such that may require cleaning to restore the vessel to a serviceable condition, and blocking or damage to WC facilities.

Lateness- please meet at your vessel at least 15 minutes before the time of the charter (or earlier, if specifically requested by the booking manager following booking). If a client or party is late, Le Mourier Swim School Ltd. reserve the right to cancel that activity and no refund will be forthcoming. If you leave your vessel/s to go ashore, please return to your vessel latest by the time requested by the skipper/crew when you leave the vessel to go ashore. Any lateness beyond this will be invoiced to the client/organiser. Our timings are tight on any given day and so if guests are late or cause unreasonable delays such that the charter cannot be completed in the time they’ve booked, we will charge for the extra time and expenses which have been incurred. Your party may be left somewhere if you do not return to the boat at the time requested!

Health & Safety:

Le Mourier Swim School Ltd. will endeavour to follow industry best practices and Health & Safety guidelines to make every reasonable effort to reduce and eliminate the likelihood of accidents or injury, however, it must be understood and accepted by all attendees on any charter, trip or tour that by the nature of sea-going activity elements of risk are always present and cannot be completely mitigated.

Le Mourier Swim School Ltd. insists that all safety precautions be adhered to fully and completely and to remove and/or exclude members/customers or cancel charters immediately in any circumstances it deems necessary due to a lack of compliance in this respect, including as a result of intoxication of any guest.

Photography:

It is possible that the media/Le Mourier Swim School Ltd. may film or take photos during the activities although we will not allow private photography. By booking you are expressing your agreement to this as detailed in our terms and conditions. You also agree that these images can be kept on our secure database to be held solely for Le Mourier Swim School which will not be given to any third party.

 

Updated Le Mourier Marine Covid-19 SOPs

The procedures below will be supplemented by dynamic risk assessments in order to identify any other areas or procedures necessary to safeguard health and safety including in connection with COVID-19 precautions.

Charters

– Social distancing will be implemented between the skipper and passengers as per Government of Jersey Guidance wherever possible.
– Social distancing will be implemented between passengers where necessary.
– Before and after charters, any common touch points will be disinfected.  Touch points include seats, tables, toilets (as applicable), stairs, ladders, inflatable tubes on the ribs and all grab handles.
– Shared equipment on charters is limited to lifejackets. These will be sterilised in between each charter.  Clients will be be shown how to don their sterilised life jacket whilst keeping distancing enforced between staff and separate households as per Government of Jersey guidance.

Tuition

– Social distancing will be implemented between the instructor and students as per Government of Jersey Guidance.
– Social distancing will be implemented between students where necessary.
– Before the start of each course and frequently throughout the day during hourly breaks, any common touch points will be disinfected and disinfectant will be available throughout.
– Where lifejackets are to be provided to students, these will be sterilised in between each course.  Clients will be be shown how to don their sterilised life jacket whilst keeping 2m distancing enforced between staff and separate households as per Government of Jersey guidance

Skippering Private Vessels

– Social distancing will be implemented between the skipper, crew and those on the boat – as per Government of Jersey Guidelines.
– The skipper will disinfect any common touch points upon arrival at the boat.
– The skipper & crew will have relevant PPE and hand steriliser with them at all times
